New Language, New Problems: Emerging Issues in Additional Insured Coverage Since the 2004 Revision of the ISO-Form Endorsements

In an article published in the March 2022 issue of DRI’s For The Defense, Charles A. Hafner and Alida Pecanin discuss the Insurance Services Office (ISO)’s 2004 revisions to its suite of additional insured endorsements, which shifted the language from an “arising out of” standard to an allegedly narrower “caused in whole or in part by” standard.
 
Following the revisions, courts nationwide have struggled to agree on the scope of coverage provided under the new language. Even now, more than 17 years after the introduction of the revised endorsements, no consensus has emerged. In their article, Charles and Alida detail the varying approaches taken by courts in grappling with the revised language and outline some additional and emerging issues resulting from the 2004 revisions.
