Monica T. Sullivan Presented On Bermuda Form Issues and Arbitration
On December 5, Nicolaides LLP partner Monica T. Sullivan presented Bermuda Form Issues and Arbitration at the Insurance Coverage & Practice Symposium in New York, New York.
Bermuda insurers and versions of the Bermuda Policy Form are involved in coverage disputes with increasing regularity. Monica's presentation addressed the history of the Bermuda market, jurisdictional concerns, and provided an overview of the Bermuda Form, including “Occurrence Reported” coverage, notice issues, aggregation of claims, and the maintenance deductible defense. Her presentation also covered the mechanics of Bermuda Form arbitrations.
The ICP is DRI's annual insurance coverage symposium. This year's program was co-chaired by Nicolaides LLP partner Sara M. Thorpe and, in addition to Monica's presentation, included an address by a judge from New York's highest appellate court and presentations by claims executives, outside counsel, a UCLA law school professor, and a jury consultant on topics such as ethical considerations in insurer communications, duty to settle, insurer recoupment, the privacy offense, social media as an investigative tool, and self-insured retentions.
